1. Acceptance of Terms
By creating an Elephant account or using the service, you agree to these Terms of Service. If you do not agree, you may not use Elephant.
2. Account Registration
To use Elephant, you must provide accurate information including:
Email address
Password
Full name or Company name
You are responsible for maintaining the confidentiality of your login credentials.
3. Acceptable Use
You agree not to use Elephant to:
Engage in unlawful activities.
Publish pornographic, sexually explicit, exploitative, fraudulent, misleading, or otherwise prohibited content.
Impersonate another person, business, or organization.
Violate others' privacy, intellectual property, or legal rights.
Upload spam, malicious content, or harmful links.
Interfere with Elephant's operation or attempt to bypass its security measures.
Misuse the platform or violate applicable laws.
These rules apply to all content you publish on Elephant.
We may remove content that violates these Terms and suspend or terminate accounts responsible for violations, where appropriate and in accordance with applicable law.
4. One-Time Purchases and Subscriptions
Elephant offers an optional monthly subscription that allows businesses to create and share multiple static objects on the platform.
Subscription and Billing
Subscriptions are purchased through Apple App Store or Google Play, depending on the platform used.
Subscriptions are billed according to the price and billing period displayed at the time of purchase. Monthly subscriptions automatically renew unless cancelled before the next renewal date.
Cancellation
Users can cancel their subscriptions at any time through their Apple or Google account subscription settings.
Cancelling a subscription stops future automatic renewals. Users retain access to subscription features until the end of their current paid subscription period, unless otherwise required by the payment provider.
Expired Subscriptions
When a subscription expires, users lose access to subscription-only features.
Static objects created through the subscription will no longer be visible to other users while the subscription is inactive. The objects may become visible again if the user renews or restores an eligible active subscription.
One-Time Purchases
Certain events and activities require a separate one-time purchase to complete and publish them on Elephant. The applicable price is displayed before the user confirms the purchase.
One-time purchases are separate from subscriptions and do not automatically renew.
Refunds
Refund requests for purchases made through Apple App Store or Google Play are generally handled by the respective payment provider, subject to its refund policies and applicable consumer protection laws.
Payment Issues
If a subscription payment fails, access to subscription features may be affected according to the subscription status and applicable billing grace periods.
Users can contact Elephant support if they experience problems with purchases or subscription access.
5.Inactive Guest Accounts
Free guest accounts may be deleted after 12 consecutive months of inactivity. Users who wish to keep their guest accounts should access and use the app before the inactivity period expires. Once deleted, guest accounts may not be recoverable.
6. Service Availability
We strive to keep Elephant running smoothly but cannot guarantee uninterrupted availability. We may modify or discontinue features at any time.
7. Intellectual Property
All content, trademarks, and technology within Elephant belong to us or our licensors. You may not copy, modify, or redistribute our materials without permission.
8. Termination
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms or pose security risks.
9. Limitation of Liability
To the fullest extent allowed by law, Elephant is not liable for:
Lost profits
Data loss
Indirect or incidental damages
Your use of the app is at your own risk.
10. Governing Law
These Terms may be governed by the laws of your country or region, depending on your jurisdiction.
11. Changes to These Terms
We may update these Terms occasionally. By continuing to use Elephant after updates, you accept the new Terms.
